Estos Términos y Condiciones («Términos») regulan el acceso y uso del sitio web, la waitlist y los servicios ofrecidos por Juan Manuel García Montealegre, persona natural con domicilio en Bogotá D.C., Colombia, que opera el servicio bajo el nombre comercial Fomi («el Operador», «nosotros»). Fomi («el Servicio») es el nombre comercial de dicho servicio. Al acceder o utilizar Fomi, aceptas quedar vinculado por estos Términos. Si no estás de acuerdo, no uses el Servicio.
1. Descripción del servicio
Fomi es un agente de inteligencia artificial que opera dentro de Slack y se conecta con herramientas de terceros para ejecutar tareas en nombre de los usuarios. El Servicio puede encontrarse en fase de acceso anticipado, beta o waitlist, con funcionalidades limitadas, cambios frecuentes o interrupciones temporales.
2. Elegibilidad y cuenta
Debes tener al menos 18 años y capacidad legal para contratar, o contar con autorización de tu organización. Eres responsable de mantener la confidencialidad de tus credenciales y de toda actividad realizada bajo tu cuenta o workspace.
3. Uso aceptable
Te comprometes a no:
- Usar el Servicio para actividades ilegales, fraudulentas o que infrinjan derechos de terceros.
- Intentar acceder sin autorización a sistemas, datos o cuentas ajenas.
- Interferir con la seguridad, estabilidad o rendimiento del Servicio.
- Realizar ingeniería inversa, descompilar o extraer el código fuente salvo cuando la ley lo permita.
- Enviar contenido malicioso, spam o material que vulnere políticas de Slack u otras plataformas integradas.
- Utilizar el Servicio para tomar decisiones automatizadas de alto riesgo sin supervisión humana cuando la ley lo exija.
4. Contenido generado por IA — descargo de responsabilidad
Las respuestas, sugerencias y acciones de Fomi son generadas por sistemas de inteligencia artificial y pueden ser incompletas, incorrectas o desactualizadas. EL SERVICIO NO SUSTITUYE ASESORAMIENTO LEGAL, FINANCIERO, MÉDICO NI PROFESIONAL DE NINGÚN TIPO.
Eres el único responsable de revisar, validar y aprobar cualquier acción ejecutada por Fomi en tus herramientas (CRM, calendario, correo, etc.). Nosotros no garantizamos la exactitud, integridad ni idoneidad de los resultados.
5. Integraciones de terceros
El Servicio depende de plataformas de terceros (Slack, HubSpot, Google, etc.). No somos responsables de la disponibilidad, cambios, interrupciones, políticas ni prácticas de dichos terceros. Tu uso de integraciones está sujeto también a los términos de cada proveedor.
Puedes revocar permisos de integración en cualquier momento desde las configuraciones correspondientes de cada plataforma o de Fomi.
6. Propiedad intelectual
Fomi, su marca, software, diseño, documentación y contenido propio son propiedad del Operador. Te concedemos una licencia limitada, no exclusiva, revocable e intransferible para usar el Servicio conforme a estos Términos.
Conservas la propiedad de los datos y contenidos que aportes. Nos otorgas una licencia necesaria para procesarlos únicamente con el fin de prestar el Servicio.
7. Waitlist y acceso anticipado
Unirte a la waitlist no garantiza acceso al Servicio ni condiciones comerciales específicas. Podemos seleccionar usuarios, modificar precios, funcionalidades o discontinuar el programa de acceso anticipado en cualquier momento sin responsabilidad hacia ti.
8. Exención de garantías
EL SERVICIO SE PROPORCIONA «TAL CUAL» Y «SEGÚN DISPONIBILIDAD», SIN GARANTÍAS DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS, INCLUIDAS —SIN LIMITACIÓN— GARANTÍAS DE COMERCIABILIDAD, IDONEIDAD PARA UN FIN PARTICULAR, NO INFRACCIÓN, EXACTITUD O DISPONIBILIDAD ININTERRUMPIDA.
No garantizamos que el Servicio esté libre de errores, virus, vulnerabilidades o que satisfaga tus expectativas particulares.
9. Limitación de responsabilidad
EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY APLICABLE, EN NINGÚN CASO SEREMOS RESPONSABLES POR DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES, CONSECUENTES, PUNITIVOS O PÉRDIDA DE BENEFICIOS, DATOS, REPUTACIÓN O OPORTUNIDADES DE NEGOCIO, AUNQUE HAYAMOS SIDO ADVERTIDOS DE SU POSIBILIDAD.
NUESTRA RESPONSABILIDAD TOTAL ACUMULADA POR CUALQUIER RECLAMACIÓN RELACIONADA CON EL SERVICIO NO EXCEDERÁ EL MAYOR DE: (A) LOS IMPORTES QUE NOS HAYAS PAGADO EN LOS DOCE (12) MESES ANTERIORES A LA RECLAMACIÓN; O (B) CUATROCIENTOS MIL PESOS COLOMBIANOS (COP $400.000), SI NO HAS REALIZADO PAGOS.
Algunas jurisdicciones no permiten ciertas limitaciones; en esos casos, nuestra responsabilidad se limitará al máximo permitido por la ley.
10. Indemnización
Aceptas indemnizar, defender y mantener indemne al Operador frente a reclamaciones, daños, pérdidas, costes y gastos (incluidos honorarios legales razonables) derivados de: (a) tu uso del Servicio; (b) tu incumplimiento de estos Términos; (c) el contenido o datos que proporciones; o (d) acciones ejecutadas por Fomi bajo tus instrucciones sin la revisión adecuada.
11. Suspensión y terminación
Podemos suspender o cancelar tu acceso al Servicio, con o sin previo aviso, si incumples estos Términos, si es necesario por seguridad o cumplimiento legal, o si discontinuamos el Servicio. Tras la terminación, cesan tus derechos de uso y pueden aplicarse las disposiciones que por su naturaleza deban sobrevivir.
12. Modificaciones
Podemos modificar estos Términos en cualquier momento publicando la versión actualizada en https://fomiapp.com. El uso continuado del Servicio tras la entrada en vigor de los cambios constituye tu aceptación. Si no aceptas los cambios, debes dejar de usar el Servicio.
13. Ley aplicable y jurisdicción
Estos Términos se regirán e interpretarán conforme a las leyes de la República de Colombia, sin tener en cuenta conflictos de normas. Salvo disposición legal imperativa en contrario, las partes se someten a los tribunales de Bogotá D.C. (Colombia), renunciando a cualquier otro fuero que pudiera corresponderles.
14. Disposiciones generales
Si alguna cláusula resultara inválida, el resto permanecerá en vigor. La falta de ejercicio de un derecho no implica renuncia. No puedes ceder estos Términos sin nuestro consentimiento escrito.

1. Service description
Fomi is an artificial intelligence agent that operates within Slack and connects to third-party tools to perform tasks on behalf of users. The Service may be in early access, beta, or waitlist phase, with limited features, frequent changes, or temporary interruptions.
2. Eligibility and account
You must be at least 18 years old and legally able to contract, or have authorization from your organization. You are responsible for maintaining the confidentiality of your credentials and all activity under your account or workspace.
3. Acceptable use
You agree not to:
- Use the Service for illegal, fraudulent activities or activities that infringe third-party rights.
- Attempt unauthorized access to systems, data, or accounts.
- Interfere with the security, stability, or performance of the Service.
- Reverse engineer, decompile, or extract source code except where permitted by law.
- Send malicious content, spam, or material that violates Slack or other integrated platform policies.
- Use the Service for high-risk automated decisions without human oversight where required by law.
4. AI-generated content — disclaimer
Fomi's responses, suggestions, and actions are generated by artificial intelligence systems and may be incomplete, incorrect, or outdated. THE SERVICE DOES NOT PROVIDE LEGAL, FINANCIAL, MEDICAL, OR PROFESSIONAL ADVICE OF ANY KIND.
You are solely responsible for reviewing, validating, and approving any action executed by Fomi in your tools (CRM, calendar, email, etc.). We do not guarantee the accuracy, completeness, or suitability of results.
5. Third-party integrations
The Service depends on third-party platforms (Slack, HubSpot, Google, etc.). We are not responsible for their availability, changes, interruptions, policies, or practices. Your use of integrations is also subject to each provider's terms.
You may revoke integration permissions at any time through the relevant platform settings or Fomi settings.
6. Intellectual property
Fomi, its brand, software, design, documentation, and proprietary content are owned by the Operator. We grant you a limited, non-exclusive, revocable, non-transferable license to use the Service in accordance with these Terms.
You retain ownership of data and content you provide. You grant us a license necessary to process it solely to provide the Service.
7. Waitlist and early access
Joining the waitlist does not guarantee access to the Service or specific commercial terms. We may select users, modify pricing, features, or discontinue the early-access program at any time without liability to you.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING —WITHOUT LIMITATION— WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY.
We do not warrant that the Service will be error-free, virus-free, vulnerability-free, or meet your particular expectations.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, REPUTATION, OR BUSINESS OPPORTUNITIES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) FOUR HUNDRED THOUSAND COLOMBIAN PESOS (COP $400,000), IF YOU HAVE MADE NO PAYMENTS.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Operator from claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your breach of these Terms; (c) content or data you provide; or (d) actions executed by Fomi under your instructions without adequate review.
11. Suspension and termination
We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if required for security or legal compliance, or if we discontinue the Service. Upon termination, your right to use the Service ceases and provisions that by nature should survive will remain in effect.
12. Modifications
We may modify these Terms at any time by posting the updated version at https://fomiapp.com. Continued use of the Service after changes take effect constitutes your acceptance. If you do not accept the changes, you must stop using the Service.
13. Governing law and jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia, without regard to conflict-of-law principles. Unless mandatory law provides otherwise, the parties submit to the courts of Bogotá D.C., Colombia, waiving any other jurisdiction that may apply.
14. General provisions
If any provision is invalid, the remainder remains in effect. Failure to enforce a right does not constitute a waiver. You may not assign these Terms without our written consent.
